Our Business Dispute Attorney Can Work to Keep the Case Out of Court
Early in the process of meeting with our clients, many of them often express a desire to avoid having their cases go to court. Several reasons exist for wanting to try to solve a business legal dispute without having to go through a trial in open court.
Precise outcome: When we are able to negotiate a settlement to the dispute before going to trial, we can secure a sure outcome in the case. If the case ends up in the hands of a jury or judge, we cannot guarantee the outcome will be in our favor.
Less cost: If our business dispute lawyer can deliver a desirable outcome during negotiations, we will be investing fewer hours than what we would be doing when a trial is necessary. This means you end up with a smaller legal bill when we negotiate an outcome outside of a trial.
Reduced publicity: Depending on the type of business you operate, having a dispute end up in open court could create unwanted publicity. During an out-of-court settlement through negotiations, we can require that all parties involved refrain from speaking publicly about the negotiated settlement, keeping the dispute out of the news.
Our Business Dispute Attorney Will Work Toward a Creative Out-of-Court Solution
We have a number of different methods we can deploy in an effort to settle the dispute without the need to go to open court. Trust that our business dispute attorney will work hard at making one of these methods work to create the private settlement you are seeking.
Negotiations: Negotiating is the most common way to achieve a settlement without going to trial. We will lay out the areas of dispute with the other party or the other party’s attorneys, and we then will meet to attempt to find common ground on each of those areas. We will listen to the other party during negotiations, but we will make sure that your needs and wants are obvious to the other party as well. Multiple offers and counteroffers are common during this process, which some clients find frustrating, but they are part of normal negotiations.
Conciliation: Conciliation has some similarities to negotiation. Rather than having each of the parties attempt to come up with common ground, however, a third party will suggest a common ground as a starting point. The conciliator will start by listening to each party’s concerns before suggesting a starting point for negotiations. This can be a good way to kick off negotiations when both parties are being stubborn regarding their positions.
Arbitration: We may be able to make use of a neutral third party who can help us and the other party try to come to a settlement. We may be able to reach a settlement on some of the issues in the dispute through face-to-face negotiations, but we may need an arbitrator to help us work through the last few issues on which we are struggling.
Facilitation: Sometimes, we may have a situation where you and the other party are disagreeing on exactly what issues are causing the dispute. Without agreement on the issues you are facing, it is nearly impossible to begin negotiating a settlement. A facilitator is someone who can help those in a dispute to figure out the origins of the dispute and to determine exactly what aspects of the dispute are causing the most problems.
As we deploy these various options for attempting to solve the dispute out of court, we will provide advice for you along the way. As we work through the case, we may reach a point where we believe one of these methods is no longer moving us toward the ultimate goal. We then may suggest that we shift to a new method, seeking to make headway by changing tactics.
Our Business Dispute Lawyer Will Keep You Informed at Every Step
Trust that our business dispute lawyer will attempt to negotiate a settlement that fits the kind of outcome you are seeking. However, when the other party refuses to negotiate fairly, we are not afraid to take the case to court to achieve the outcome you want. Some attorneys may attempt to avoid court at all costs, but we take pride in being able to talk about our clients’ stories in court when necessary. The most important thing for us is making sure you have the best chance of receiving the outcome you are seeking.
When we represent you, all decisions we make about how to proceed in your case will involve a collaborative discussion and decision between you and our team. We want you to be fully involved in the decision-making process. Our business dispute lawyer will provide advice about how we think we should proceed in the case, but you will always have the final say. We will work with you as a team.
