THE WEISBLATT LAW FIRM, PLLC (“the Firm”) is committed to protecting your privacy.

You SHOULD NOT send confidential information or information that you regard as privileged to the Firm until you have a written and signed agreement from the Firm for any legal services you may request. The content of any correspondence you send via the internet may not be considered confidential unless you have received such written confirmation.

Emails, text messages, and/or other electronic messages that transmit via the internet or by phone (and any files transmitted with them) may contain confidential information subject to attorney-client, attorney work-product, or other legal privileges, or that is otherwise protected by law, including the Electronic Communications Privacy Act, 18 U.S.C. §§ 2510-2521, from unauthorized disclosure or use. If you are not the intended recipient, then: (1) you have received such information through inadvertent error; (2) no intention to waive any privileges or rights should be implied; (3) you must not make any disclosure, distribution, copying, or use of it; (4) please delete the original and any attachments and duplicates; and (5) please advise the Firm of this error via a new email (not as a reply).

SMS PRIVACY POLICY

This SMS Privacy Policy (the “SMS Policy”) governs how we treat the Personal Information that we collect and receive from you in connection with your use of the SMS Service (“Service”), which we make available to you through a third-party service provider.

By using the Service, you agree to the terms of this SMS Policy. The Firm reserves the right, in its sole discretion, to modify or change this SMS Policy at any time with or without prior notice to you. The date of the last update will be posted at the top of this SMS Policy for your convenience. This SMS Policy, and any changes, are effective as soon as posted. Your continued use of the Service following the posting of any changes to the SMS Policy constitutes your full acceptance of those changes.

“Personal Information” is information that individually identifies you, such as your mobile phone number or user/screen name, as well as the any Personal Information that you choose to include in messages you voluntarily send through the Service to the Firm.

What Personal Information is collected about you through SMS
Through the use of the Service, the Firm will receive the following information from our third party service provider: your mobile phone number when you send a text message to us, the text of messages that you send to other users of the Service, any user or screen name that you select in connection with the Service, as well as any comments or feedback regarding the Service that you send to us. In addition to this information, the Firm may collect the following information you voluntarily provide to or exchange with us through use of the Service:

• Personal Information — names, postal address, email address, telephone numbers, and any other details you voluntarily provide (e.g., details involving your legal matters).
• Transactional Information — details related to your account, payment status, and communications related to our services.
• Legal Information — details related to your case or legal matter, such as notices related to hearings or relevant dates in litigation, facts involving your case, addresses, websites, or phone numbers related to hearings, or other information related to your legal matter.
• SMS Consent Records — timestamp and proof of opt-out for text messaging.

How Personal Information is collected about you through SMS
Personal Information is collected by your communications through the Service with the Firm and its staff.

How the Firm uses Personal Information about you
We use Personal Information collected through the Service to:

• provide you with the Service;
• process and respond to inquiries;
• improve the Service;
• provide, operate, and improve our legal services;
• schedule appointments, send reminders, and information related to legal settings;
• send invoices, payment reminders, and other account notices; and/or
• respond to inquiries and provide updates.

Each message that you send through the Service is stored on our servers. We retain these messages on our servers. The Firm utilizes servers and services owned by third parties.

Disclosure of your information
We will not rent or sell your Personal Information to other companies or individuals.

SMS consent and phone numbers are not shared with third parties or affiliates for marketing purposes.

We will not disclose any information protected by attorney-client privilege. Subject to that fundamental protection, we may disclose other Personal Information only in the following limited circumstances:

• You have given us your consent.
• We are responding to a subpoena, court order, or other legal process; asserting or defending legal claims; or otherwise protecting legal rights—ours or others’.
• We believe disclosure is necessary to investigate, prevent, or address unlawful conduct, suspected fraud, threats to safety, or to comply with legal obligations.

SMS Security
The Firm takes precautions to ensure the security of your Personal Information, including investigating that our third-party service providers protect the security of your Personal Information. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your Personal Information despite our efforts. You should note that in using the Service, your information will travel through third party infrastructures which are not under our control (such as a third-party SMS delivery platform or your personal carrier network).

Opting in
A mobile user might opt-in by providing verbal consent to a Firm representative, who will provide disclaimers and direct your attention to this SMS Policy. Your opt-in time and agreement will be recorded and tracked.

Opting out
The Firm’s third-party service provider gives you the ability to opt out of the Service for any reason. You can opt out by texting “STOP” at any time or notifying a Firm representative.

Children
The Service is not intended for children under 13, and the Firm does not knowingly collect information from children under the age of 13.
By using the Service, you are representing that you are at least 18.

Intended audience
The Firm requires that users of this service be limited to US residents only and only the residents of States in which the Firm regularly conducts business.

By opting into to the Service, you agree to receive text messages from the Firm for:
• Appointment scheduling & reminders;
• Updates, discussion, and notices related to your legal matter;
• Non-marketing-based phone numbers or web addresses, exclusively related to your legal matter; and
• Billing or payment notice;
